Terms of Use

These terms are an agreement between you and The Ideas Garden(“we”, “us”), covering the website at theideasgarden.com and the app (together, the “Service”). By creating an account or using the Service you agree to them. If you do not agree, please do not use the Service.

1. Who can use the Service

You must be at least 13 years old. If you are under the age of majority where you live, you may only use the Service with the involvement of a parent or guardian. You are responsible for keeping your login credentials secure and for activity that happens under your account.

2. Your account

You can browse and use the Service as a guest, in which case your data is stored only in your own browser. Creating an account lets us sync your data across devices. You are responsible for the accuracy of the information you give us.

3. Your content

The ideas, notes and other content you create remain yours. We claim no ownership over them. You grant us only the limited permission needed to operate the Service, namely to store, back up and display your content back to you.

You agree not to use the Service to store or share content that:

• is unlawful, or infringes someone else's rights;
• harasses, threatens or defames another person;
• contains malware or attempts to compromise the Service;
• attempts to gain unauthorised access to other users' accounts or data.

We may remove content or suspend accounts that breach these terms.

4. Free trial, plans and billing

Every new account includes a 7-day free trial with full access and no payment details required. After the trial you may choose a paid plan:

• Monthly Pass: $5.00 per month, recurring until cancelled.
• Lifetime Access: $30.00 as a single payment.

Payments are processed by Stripe. We do not receive or store your full card details. Recurring plans renew automatically until you cancel. You can cancel at any time from Settings; cancellation stops future charges and you keep access until the end of the period you have already paid for. Prices are in USD and exclude any taxes that may apply in your country.

“Lifetime” means a one-off payment with no recurring charge, for as long as we continue to operate the Service. It is not a guarantee that the Service will run indefinitely.

5. Refunds

If you are unhappy with a purchase, contact us within 14 days at hello@theideasgarden.com and we will refund you. This is in addition to any statutory refund or withdrawal rights you have as a consumer, which we do not limit.

6. Service availability and changes

We aim to keep the Service running but we do not guarantee it will be uninterrupted or error-free. We may add, change or remove features. If we plan to discontinue the Service entirely, we will give reasonable notice and a way to export your data.

7. Acceptable use

Do not resell or redistribute the Service, scrape it, place unusual load on it, reverse engineer it, or use it to build a competing product from our data. Automated bulk account creation is not permitted.

8. Ending your access

You may stop using the Service and delete your account at any time. We may suspend or terminate accounts that materially breach these terms, normally after notice unless the breach is serious or unlawful.

9. Disclaimers

To the extent permitted by law, the Service is provided “as is” without warranties of any kind. Nothing in these terms excludes liability that cannot legally be excluded, including for death or personal injury caused by negligence, or for fraud.

10. Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential loss, loss of profits, or loss of data beyond what reasonable backups would recover. Our total liability to you in any 12-month period is limited to the greater of the amount you paid us in that period, or USD 50. Your statutory consumer rights are unaffected.

11. Changes to these terms

We may update these terms. If a change is material we will give notice in the app or by email before it takes effect. Continuing to use the Service after that means you accept the updated terms.

12. Governing law

These terms are governed by the laws of Slovakia, and the courts of Slovakia have jurisdiction. If you are a consumer, you keep the protection of the mandatory laws of the country where you live and may bring proceedings there.
